Abstract
This study discusses the women of Minangkabau as preserved the marriage. Law of psychologically approach the convicted criminal insufficient stigmatic personal, but dragging the prestise family because of ethnic communal. Minangkabau and the matrilineal genetic relationship makes Minangkabau’s women be an ultimate source of wisdom as a existential genetic relationship. Then it is not to overact makes Minangkabau’s women becomes a symbol the greatness of this system. The focus of this study is the idea reading for reasoning reciprocal of Faqihuddin Abdul Kadir. This research puts the theory of Qiraah Mubadalah in analyzing data. The theory was chosen for legal sociology analysis. As a result founded the form of preserved wife, the two things focus this study are about wife takes a double burden. Husband’s condition becomes the head of the houshold. Then legal authority of Niniak mamak and Kamanakan by providing protection as well as guidance for everything. This form defense the concept of marriage, namely mu'asyarah bil ma'ruf in the husband and wife relationship. This means that flexibility in the rights and obligations of husband and wife, which is reflected in a reciprocal mindset towards resentment and cooperation, is a benchmark for efforts to maintain the household.
